LOYALTY PROGRAM TERMS AND CONDITIONS

1. OPERATOR DETAILS

 

The organizer and operator of the Loyalty Program (hereinafter referred to as: Program) is:

(hereinafter referred to as: Operator)

 

The Operator operates the Program to support its commercial activities, reward customer loyalty, and provide discounts and other benefits.

 

2. PURPOSE AND SCOPE OF THE REGULATIONS AND NATURE OF THE PROGRAM

 2.1. These Regulations define the conditions for participation in the Program, the rules for point collection, point redemption, discounts, coupons, loyalty levels, referral programs, and other rules for the operation of the Program.

 

2.2. A brief summary of the Program is provided in the "Loyalty Program – Short Information" published on the Operator's website. The Short Information is for informational purposes only.

 

The full legal and other terms and conditions applicable to the Program are contained in these Regulations in all cases.

 

2.3. By participating in the Program, the Participant accepts the provisions of these Regulations.

 

2.4. The Program does not qualify as a financial service, electronic money system, investment scheme, or gift voucher program. The points registered within the Program are exclusively for claiming the discounts specified in these Regulations.

 

2.5. Participation in the Program is free of charge.

 

3. DEFINITIONS

 

For the purposes of these Regulations:

 

3.1. Program: the loyalty and rewards program operated by the Operator.

 

3.2. Participant: a natural person who has joined the Program and has a valid Customer Account.

 

3.3. Customer Account: the user profile created in the webshop.

 

3.4. Point: a unit of discount entitlement registered electronically within the Program.

 

A point is:

  • not money;
  • not electronic money;
  • not a proprietary right;
  • not a claim;
  • not convertible to cash.

 

3.5. Coupon: an electronic or other form of entitlement provided by the Operator, granting a discount.

 

3.6. Loyalty Level: the status achieved by the Participant based on their accumulated points.

 

3.7. Alpha Loyalty Program Rewards: external software system supporting the operation of the Program.

 

3.8. Unauthorized Point Acquisition: any conduct aimed at acquiring points or claiming discounts in a manner contrary to the purpose of the Program.

 

4. CONDITIONS FOR PARTICIPATION IN THE PROGRAM

 

4.1. Participation in the Program is voluntary.

 

4.2. Conditions for joining the Program:

  • creation of a customer account;
  • acceptance of these Regulations;
  • provision of necessary data.

 

4.3. No physical or electronic loyalty card will be issued in connection with the Program.

 

4.4. All points, discounts, coupons, and levels are recorded electronically.

 

4.5. The Participant is obliged to provide truthful data.

 

4.6. The Operator is entitled to exclude any Participant from the Program who:

  • provides false data;
  • uses multiple user accounts;
  • engages in abusive conduct;
  • acts in a manner contrary to the purpose of the Program, including, but not limited to, seeking Unauthorized Point Acquisition.

5. REGISTRATION AND MEMBERSHIP RELATIONSHIP

 

5.1. Program membership is established upon successful completion of registration.

 

5.2 A Participant may only have one active Program membership.

 

5.3. Program membership is personal.

 

5.4. Points, coupons, and discounts are not transferable.

 

5.5. Program membership ceases:

a) at the Participant's request;

b) by deleting the customer account;

c) in case of exclusion;

d) upon termination of the Program.

 

5.6. Upon termination of membership, unused points and discounts are lost.

 

6. THE ALPHA LOYALTY PROGRAM REWARDS SYSTEM

6.1. The technical background of the Program is provided by the Alpha Loyalty Program Rewards system.

6.2.The system automatically handles:

 

  • point credits;
  • point deductions;
  • coupons;
  • loyalty levels;
  • discounts.

 

6.3.The Participant acknowledges that the Operator uses an external service provider to operate the Program.

 

6.4. The Operator's Data Protection Policy applies to the handling and processing of personal data necessary for the operation of the Program.

 

6.5. The appearance of points, discounts or levels may not necessarily occur in real time.

 

6.6. The Operator is entitled to correct any errors resulting from technical issues in:

 

  • point credits,
  • point deductions,
  • coupons,
  • level classifications  

retrospectively.

 

6.7. The Participant does not acquire entitlement to points credited due to an obvious system error.

 

7. POINT COLLECTION

7.1. The Participant is entitled to earn 1 point for every HUF 100 gross purchase value started.

 

7.2. Points are only awarded after a successfully completed and paid purchase.

 

7.3. No points can be earned on the amount of the shipping fee.

 

7.4. In the case of gift cards, vouchers, or special promotional products, the Operator may apply different rules.

 

7.5. The Operator may periodically announce multiple point-earning promotions.

 

7.6. Points can also be earned on discounted or other promotional products, provided it is done in accordance with the provisions of these Regulations.

 

8. REGISTRATION, NEWSLETTER AND BIRTHDAY POINTS

 

8.1. Registration bonus

 

Upon successful registration: 200 points will be credited.

 

8.2. Newsletter subscription bonus

 

Upon subscribing to the newsletter: 250 points are awarded.

 

8.3. If the Participant unsubscribes from the newsletter after subscribing, the Operator is entitled to withdraw the credited points.

 

8.4. Birthday points

 

On the Participant's birthday: 300 points will be credited.

 

9. POINT REGISTRATION AND EXPIRATION

 

9.1. Points are recorded in the Customer Account.

 

9.2. The Participant is obliged to regularly check their point balance.

 

9.3. If the Participant does not make a purchase in the webshop or physical store for 365 consecutive days, their points will be deleted. The 365-day period under this point restarts with each purchase.

 

9.4. Expired points cannot be restored.

 

9.5. The Operator is entitled to retroactively correct erroneous point credits.

 

9.6. In case of discrepancy, the Participant is entitled to contact customer service.

 

10. POINT REDEMPTION RULES

 

10.1. Points can be used in both the webshop and physical store.

 

10.2. Points are not convertible to cash.

 

10.3.Points are not transferable.

 

10.4. Points can be redeemed for the following discounts:

10.5. The discount will be deducted from the gross purchase price.

 

10.6. If points are redeemed during a purchase, new points will be credited for that purchase based on the difference between the total gross amount of the purchase and the gross amount corresponding to the deducted points.

 

10.7.Points cannot be combined with other (even temporary) discounts or promotions. For clarity, the Operator states that points cannot be redeemed for discounted products.

 

10.8. Unless otherwise specified, only one percentage discount coupon can be used per purchase.

 

10.9. The Operator reserves the right to exclude certain product families from point redemption. Thus, the Operator informs Participants that points cannot be redeemed for products of the following brands:

· Móra,

· Tornadora,

· Pelso,

· Little Dutch,

· Usborne

11. LOYALTY LEVELS AND LEVEL DISCOUNTS

 

11.1. Purpose of the level system

Within the Program, the Operator rewards regularly returning customers with special loyalty levels. Achieving loyalty levels may entitle the Participant to further discounts and coupons.

 

Level discounts are special benefits provided by the Program, which are not convertible to cash and are not transferable to other persons.

 

11.2. Bronze level

 

The Participant achieves Bronze level if they collect at least 1,000 points during the qualification period.

 

The reward for achieving Bronze level is:

  • a one-time 5% discount coupon.

 

11.3. Silver level

 

The Participant achieves Silver level if they collect at least 1,750 points during the qualification period.

 

The reward for achieving Silver level is:

  • a one-time 10% discount coupon.

 

11.4. Gold level

 

The Participant achieves Gold level if they collect at least 2,750 points during the qualification period.

 

The reward for achieving Gold level is:

  • a one-time 20% discount coupon.

 

11.5. Platinum level

 

The Participant achieves Platinum level if they collect at least 3,750 points during the qualification period.

 

The reward for achieving Platinum level is:

  • a one-time 20% discount coupon;
  • a HUF 10,000 coupon.

 

11.6. The HUF 10,000 coupon associated with the Platinum level automatically loses its validity if the Participant does not make a purchase in the webshop or physical store for 365 consecutive days.

 

11.7. The Operator is entitled to determine the detailed technical conditions for using level discounts.

 

12. VALIDITY PERIOD OF POINTS

 

12.1. Points and coupons only lose their validity if the Participant does not make a purchase from the Operator for 365 consecutive days, in accordance with Section 9.3 of these Regulations, or if the Operator deletes or withdraws the Participant's points according to the rules set out in these Regulations.

 

13. VALIDITY PERIOD OF LOYALTY LEVELS

 

13.1. The loyalty levels defined in Section 11 and their associated level discounts only lose their validity if the Participant does not make a purchase from the Operator for 365 consecutive days, in accordance with Section 9.3 of these Regulations, or if the Operator excludes the Participant from the Program.

 

14. RESTRICTIONS AND EXCLUSIONS

 

14.1. The Operator is entitled to define the products, product categories, manufacturers, brands, services, promotions, or sales channels for which point collection or point redemption is partially or entirely excluded or restricted.

 

14.2. Such restrictions will be published by the Operator either on the website, on the relevant product page, in the store, in these Regulations, or on other information platforms.

 

14.3. The Operator reserves the right to apply different point earning or point redemption conditions during specific periods or promotions.

 

14.4. The Operator informs Participants that points cannot be redeemed for products of the following brands:

· Móra,

· Tornadora,

· Pelso,

· Little Dutch,

· Usborne.

 

14.5. The Operator is unilaterally entitled to modify the product categories excluded from the Program.

 

15. WITHDRAWAL, RETURN, AND REFUND

 

15.1. In case of withdrawal from purchase, product return, or partial refund of the purchase price, the points associated with the affected purchase will be automatically deducted.

 

15.2. If the Participant has already used the points, the Operator is entitled to make a correction corresponding to the value of the missing points.

 

15.3. Returned or refunded purchases cannot be taken into account during level qualification.

 

15.4. The Operator is entitled to maintain a negative point balance if there are not enough available points for the deduction.

 

16. ABUSES AND EXCLUSION

 

16.1. The Program may only be used as intended.

 

16.2. Abuse specifically includes:

 

  • using false or untrue data;
  • creating multiple accounts by the same person;
  • self-referral;
  • manipulating point acquisition;
  • exploiting system errors;
  • using automated tools;
  • conduct contrary to the business purpose of the Program.

 

16.3.In case of suspected abuse, the Operator is entitled to:

  • block points;
  • suspend discounts;
  • temporarily block the account;
  • terminate Program membership.

 

16.4. The Operator's exclusion decision does not affect the possibility of enforcing any existing civil law or other legal claims.

 

17. LIMITATION OF LIABILITY AND TAX PROVISIONS

 

17.1. The Operator operates the Program with the professional diligence expected from it.

 

17.2. The Operator is not responsible for:

  • internet service outages;
  • errors in third-party systems;
  • force majeure events;
  • data transmission errors;
  • temporary service interruptions due to technical maintenance.

 

17.3. The Operator is not liable for damages resulting from incorrectly provided data by the Participant.

 

17.4. The Operator is not liable for any lost profits, business losses, data loss, indirect, incidental, or consequential damages, unless the exclusion of liability is prohibited by law.

 

17.5. Tax provisions

If any discount, coupon, prize, or other benefit provided within the Program may be considered taxable or subject to contributions under applicable laws, the person designated by law is responsible for fulfilling such obligations.

 

17.6. The Operator excludes its liability for any tax, contribution, or other public burden payment obligations that may arise on the Participant's part.

 

18. DATA MANAGEMENT

18.1. The Operator's current Data Protection Policy applies to data management related to the Program.

 

18.2. The Operator processes personal data specifically for the purposes of:

  • operating the Program;
  • recording points;
  • providing discounts;
  • customer service contact;
  • fraud prevention.

 

18.3. Data processing takes place in accordance with the provisions of GDPR, the Info Act, and other applicable data protection laws.

 

18.4. The Participant acknowledges that the Operator may use data processors during the operation of the Program, including the providers of systems ensuring the technical operation of the Program.

 

19. COMPLAINT HANDLING

 

19.1. Complaints related to the Program may be submitted to the Operator's customer service.

 

19.2. Complaints can be submitted:

  • via email;
  • by post;
  • in person.

 

19.3. The Operator shall investigate the complaint and respond in writing.

 

19.4. In handling complaints, the Operator shall act in accordance with the provisions of the relevant consumer protection laws.

20. AMENDMENT AND TERMINATION OF THE PROGRAM

 

20.1. The Operator is entitled to unilaterally modify the terms and conditions of the Program.

 

20.2. In the event of a material change to the terms and conditions of the Program, the Operator shall publish an announcement on its website at least 15 days before the effective date of the amendment.

 

20.3. The points, coupons, and entitlements already acquired shall not be affected by the amendment, except:

  • in case of a legal obligation;
  • in case of an official obligation;
  • in case of abusive use.

 

20.4. The Operator is entitled to terminate the Program at any time.

 

20.5. In the event of the termination of the Program, the Operator may provide a usage period of at least 60 days for the redemption of any remaining points and coupons.

 

20.6. No points can be collected after the date of termination.

 

20.7. Unused points, coupons, and other entitlements shall expire after the date of termination.

 

21. MISCELLANEOUS AND FINAL PROVISIONS

 

21.1. Communication between the Operator and the Participant shall primarily take place electronically.

 

21.2. The electronic record of the Program shall be considered conclusive evidence unless the Participant credibly proves otherwise.

 

21.3. The Operator is entitled to publish information related to the Program electronically.

 

21.4. Should any provision of these Regulations prove to be invalid or unenforceable, it shall not affect the validity of the other provisions of these Regulations.

 

21.5. The Operator shall be exempt from liability in cases of events beyond its control due to unavoidable causes (force majeure).

 

21.6. In matters not regulated by these Regulations, the provisions of the following laws shall apply in particular:

  • Act V of 2013 on the Civil Code;
  • Act CLV of 1997 on Consumer Protection;
  • Act CVIII of 2001 on Electronic Commerce Services;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR);
  • Act CXII of 2011 on the Right to Informational Self-Determination.

 

21.7. Hungarian law shall govern the Program and these Regulations.

 

21.8. Date of entry into force of these Regulations:
